Terms & Conditions – Drug Delivery 

(“Terms and Conditions”)

 

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OUR DRUG DELIVERY FUNCTION OR SERVICE (“DRUG DELIVERY”).  IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, PLEASE DO NOT USE THE DRUG DELIVERY FUNCTION OR SERVICE. 

 

By accessing and/or using the Drug Delivery function or service on the mobile application of Quality HealthCare (“Mobile App”), you acknowledge that you have accepted and agree to be bound by these Terms and Conditions, the Terms and Conditions of our Mobile App and the Privacy Policy Statement and Personal Information Collection Statement for our Mobile App, as well as the Terms and Conditions of Virtual Consultation and the Privacy Policy Statement and Personal Information Collection Statement for Virtual Consultation.  As these terms and conditions may be revised and/or amended from time to time without notice to you, please check these terms and conditions every time you access and/or use the Drug Delivery function or service for revisions and/or amendments (if any). 

 

1.Drug Delivery 

After your Virtual Consultation, if your medical practitioner has prescribed medication, pharmaceuticals and directions for their use and/or issued any medical certificates, referral letters, authorisation forms or other relevant documents and items to you (collectively, “Delivery Items”), the Customer Service will contact you to arrange delivery of the Delivery Items to an address designated by you for a fee. 

 

2.Delivery to be made by Third Party Service Provider: 

2.1. The delivery of Delivery Items will be provided by third party service providers. 

2.2. By using our Delivery Service, you have authorised our third party service providers to pick up your medication from the relevant medical centre or clinic and deliver the same to you for and on your behalf. Our Customer Service will advise you of the delivery case number, the estimated delivery date and time (available in the Mobile App).  Please be ready to collect the Delivery Items at the delivery address which you provide to us.

 

3. Delivery Locations 

3.1. The Drug Delivery service will be made by a third party service provider, which delivery service covers most residential and commercial addresses located on the Hong Kong Island, Kowloon and the New Territories within the same day or the next working day. 

For specific locations below, please note:  
(i) Same day delivery to addresses at the following locations is chargeable with extra charges:

4. Collection of Delivery by Patient in Person

4.1. You should collect the delivery in person at the designated address. All deliveries will be made to the entrance of delivery address which you provide.  

4.2. Our third party service providers may require you to present relevant identification information to verify your identity for the purpose of delivery and you agree to provide such further information.  

4.3. You are required to sign a delivery note and authorisation to acknowledge receipt of the delivery. You undertake to take a photograph of your Delivery Items and send the photograph to QHC to acknowledge receipt of the delivery.

 

5. Collection of Delivery by Authorised Person 

5.1. In the event that you are not available to collect delivery in person for any reason, you shall ensure that the person accepting the delivery on your behalf is over 18 years of age and is duly authorised by you, and is able to collect the delivery with the case number (available in the Mobile App) issued to you. 

5.2. Our third party service providers may require your authorised person to present relevant identification information to verify his/her identity for the purpose of delivery to you or your authorised person, and you agree to procure your authorised person to provide such further information. 

5.3. You also undertake to instruct your authorised person to (a) sign a delivery note and authorisation to acknowledge receipt of the delivery for and on your behalf and (b) take a photograph of your Delivery Items and send the photograph to QHC to acknowledge receipt of the delivery.  

 

6. Re-delivery

6.1. In the event that a delivery agent arrives at your designated address at the agreed delivery time but is not able to make the delivery for any reason (other than due to the default of the delivery agent) including if you or your authorised person fails to turn up or collect the drug at the delivery address and/or fails or refuses to sign any delivery note and/or authorisation or if you or your authorised person refuses to take a photograph of your Delivery Items and/or send the photograph to QHC at the time of collection of the delivery, the delivery will be withdrawn at our sole discretion and no refund of delivery fee will be made.   

6.2. In such circumstances, our Customer Service will contact you for re-delivery and we reserve the right to charge you additional fee for the re-delivery.   

6.3. We and/or our third party service provider shall have no liability for any failure or delay in delivering any Delivery Items to you to the extent that any failure or delay is caused by your or your authorised person’s failure to comply with its obligations under this agreement.

 

7. Charges and Fees

7.1. You undertake to pay for all charges and fees (collectively, "Charges") for the use of services in relation to Virtual Consultations and Drug Delivery. 

7.2. Where there are additional charges for delivery, such charges will be set out separately for your confirmation and payment before any delivery will be made.

 

8. Prescription Instructions

8.1. After your Virtual Consultation, our dispensing staff will contact you for the purpose of dispensing medicine and other prescribed items to you (i.e. to give you information on the correct and effective use of medicine and make sure you understand that directions on the labels of the dispensed medicines).   We will contact you either via our Mobile App or a telephone or mobile number which you may have provided to us.   

8.2. Instructions on proper use and storage of prescribed drugs and other relevant information will also be stated on the label of the dispensed items. After dispensing, the dispensary staff will contact you to do the counselling in our Mobile App or via a telephone call. 

8.3. Your well-being is the most important to us.  Our dispensing staff will use all reasonable endeavours to contact you for the purpose of dispensing medicine and other prescribed items to you via our Mobile App or via telephone calls. In the event that our dispensing staff could not contact you or if you are not contactable for the purpose of dispensing medicine and other prescribed items to you, you shall reach out to us on our Mobile App during clinic opening hours, call the relevant medical centre/clinic.

 

9. Suspension of Delivery

The Drug Delivery function and/or service may be suspended under bad weather conditions such as when typhoon signal number 8 or above, or red or black rainstorm warning signal is hoisted, or such other weather condition whereby delivery is considered unsafe or undesirable by QHC at our sole discretion without prior notice.  

 

10. Final Decision

10.1. QHC reserves the right to decline the Drug Delivery service or any delivery to any person at its sole discretion. 

10.2. We may terminate your access to and use of all or part of the Drug Delivery service with or without notice to you. 

10.3. In case of dispute, the decision of QHC is final and binding.

 

11. Disclaimer

11.1. We will not accept any responsibility or be liable in any way in relation to any use or misuse of any of the prescribed medications, medical certificates, referral letters, receipts and/or other related items. 

11.2. QHC makes every effort to ensure that information on this Mobile App is up-to-date but reserves the right to vary and/or amend any such information without prior notice or any liability. 

11.3. Delivery of the Delivery Items made to you or your authorised person for and on behalf of QHC shall be a good, valid and full discharge of QHC’s obligations to you.  

11.4. All expected delivery dates and times are estimates only. QHC will use all reasonable endeavours to procure delivery to the delivery address provided by you. We shall not be liable for any delays, change of delivery time or non-delivery by us or by our third party service providers.  

11.5. Any signature by you or your authorised person on any delivery note or other document presented for signature in connection with delivery of the Delivery Items shall be evidence that the Delivery Items have been duly delivered to you. 

11.6. Any notice of damage should be given to QHC within one day of delivery.  

11.7. We reserve the right to decline you or your authorised persons or any person from collecting any delivery at our sole discretion in the event that you and/or your authorised persons fail to comply with these Terms and Conditions including if you or your authorised person fails to turn up or collect the drug at the delivery address and/or fails or refuses to sign any delivery note and/or authorisation or if you or your authorised person refuses to take a photograph of your Delivery Items and/or send the photograph to QHC at the time of collection of the delivery. 

11.8. Our dispensing staff will use all reasonable endeavours to contact you for the purpose of counselling and dispensing medicine and other prescribed items to you. We shall not be liable for any delays for the purpose of counselling and/or dispensing medicine and other prescribed items to you.  

 

12. Third Party Service Provider - Disclaimer

12.1. None of our third party service providers, agents or representatives are authorised to make any warranties, representations or statements regarding any information in relation to our Drug Delivery service and we shall not in any way be bound by any such unauthorised warranties, representations or statements. 

12.2. To the fullest extent permitted by law, we disclaim all implied and/or express warranties, representations or undertakings not expressly contained in these Terms and Conditions.   

12.3. We disclaim any endorsement or recommendation of any third party service providers, agents or representatives which we use or refer to in relation to our Drug Delivery service. We further disclaim all liability in relation to information or materials which may be given to you by any third party service providers, agents or representatives including advertisers or sponsors, including without limitation any mistake, error, omission, infringement, defamation, falsehood or other material or omission that might offend or otherwise give rise to any claim or complaint. 

12.4. By accessing and using this Site you acknowledge and accept that the use of our Drug Delivery service (including those services provided by our third party service provider) is at your own risk. To the fullest extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential or punitive damage or for damages for loss of profit or revenue arising out of any use of, access to, or delay or inability to use or access of our Drug Delivery service and/or counselling for the purpose of dispensing medicine and other prescribed items to you (including those services provided by our third party service provider).

16. Limitation of Liability

16.1. You agree that we shall not be liable to you or any third party for any damages, costs, losses or expenses incurred or suffered by you as a result of or in relation to our or our third party service provider’s modifying or cancelling the Drug Delivery function and/or service or any part thereof. 

16.2. Whilst we have endeavoured to provide the information, features or other content in our Drug Delivery function current as at the date of publication and accurate, they are provided without warranties or representation of any kind (express or implied). In particular, no warranty or representation, express or implied, regarding accuracy, adequacy, completeness, timeliness, non-infringement, reliability, freedom from malware, security, merchantability or fitness for a particular purpose, or whether any such information, feature, content or any service made through the Drug Delivery function is appropriate or available for use. You agree that your access and/or use of the Drug Delivery function or service is entirely at your own risk and it is your responsibility to evaluate the accuracy and completeness of all information, statements, opinions and other material in any third party websites or linked sites.  

16.3. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QHC EXCLUDES All LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, DAMAGES ARISING FROM INJURIES OR DAMAGE SUSTAINED BY YOU OR OTHER INTANGIBLE LOSSES RESULTING FROM OR ARISING OUT OF YOUR ACCESS AND/OR USE OR THE INABILITY TO ACCESS AND/OR USE THE DRUG DELIVERY FUNCTION AND/OR SERVICE (INCLUDING THOSE SERVICES PROVIDED BY OUR THIRD PARTY SERVICE PROVIDER), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU FURTHER AGREE THAT QHC IS NOT RESPONSIBLE OR LIABLE TO YOU FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTY SERVICE PROVIDERS ANY INFRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS, OCCURRING IN OR THROUGH THE DRUG DELIVERY FUNCTION AND/OR SERVICE.

 

17. Other Terms and Conditions  

17.1. The terms "we", "us", "our", "ours", "QHC" and “Quality HealthCare” when used in these Terms and Conditions mean Quality HealthCare Medical Services Limited and its holding company, subsidiaries, affiliates and related companies. The terms "you", "your" and "yours" when used in these Terms and Conditions mean any user of the Drug Delivery function and/or service. 

17.2. The latest Terms and Conditions will be posted on our Mobile App, and you should always review these Terms and Conditions prior to using the Drug Delivery function and/or service to ensure that you have a current understanding of the Terms and Conditions. If you cannot access the Terms and Conditions via the Internet, we can provide a copy of the most recent Terms and Conditions to you by e-mail upon request. You will be legally bound by the updated or amended Terms and Conditions from the first time that you access and/or use the Drug Delivery function and/or service after we put the changes on our Mobile App.

18. Law & Jurisdiction 

18.1. The Drug Delivery service is provided for use within the jurisdiction of the Hong Kong Special Administrative Region of the People's Republic of China ("Hong Kong"). Access to, or use of, the Drug Delivery service or information, materials, products and/or services in the Drug Delivery function may be prohibited by law in certain countries or jurisdictions. We make no representation that the information contained herein is appropriate or available for use in other locations.   

18.2. These Terms and Conditions and all matters relating to your access to, and use of information in the Drug Delivery function and service shall be governed by and construed in accordance with the laws of Hong Kong and you agree to submit to the exclusive jurisdiction of the Hong Kong courts.

20. Language

The original English version of these Terms and Conditions has been translated into Chinese. In the event of a dispute about the contents or interpretation of these Terms and Conditions or inconsistency or discrepancy between the English version and the Chinese version of these Terms and Conditions, this English version shall prevail.
